Passed in 1991, the Telephone Consumer Protection Act has long been a barrier for health plans who want to meet their patients where they’re at– which is most often on their cell phones, texting. With the April 2021 Supreme Court ruling (Facebook, Inc. v Duguid), SCOTUS has defined the autodialer and with their ruling, given health plans the freedom to text members, without prior explicit consent.
